Online Coaching & Additional Services

1. Definitions
Fitologie: the sole proprietorship Fitologie, established in Zwolle, the Netherlands, registered with the Chamber of Commerce under number 66085659.
Participant: the natural person entering into an agreement with Fitologie.
Agreement: the agreement regarding online coaching and/or additional services.
Services: all coaching, training programmes, consultations, guidance, personal training, and related activities offered by Fitologie.
Package: the service package chosen by the Participant (Basic, Online, or Premium) as described in Article 4.
2. Applicability
These terms and conditions apply to every offer, agreement, and delivery of services by Fitologie.
By completing digital registration, the Participant declares agreement with these terms.
Deviations are only valid if confirmed in writing by Fitologie.
3. Formation of Agreement
4. Packages, Duration and Renewal
Fitologie offers three service packages. The table below provides an overview:
4.1 Basic — €299 one-time
Single payment of €299. No subscription, no automatic renewal.
Includes a written intake questionnaire to allow Fitologie to build a tailored programme.
Includes one complete 12-week training programme, one programme adjustment based on feedback, and one introductory call of up to 10 minutes.
No ongoing guidance or contact after delivery. The agreement ends automatically upon completion.
4.2 Online Coaching — €199 per month
Monthly fee of €199.
Minimum term: 6 consecutive calendar months.
After the initial 6-month period, the agreement automatically renews for successive 6-month periods at the same rate, unless terminated in writing with one calendar month's notice before the end of the current period.
Cancellation must be submitted by email at least one calendar month before the end of the current period.
Early termination within a fixed period is not possible. In the event of early termination, the full remaining amount of the current period becomes immediately due.
4.3 Premium Coaching — €549 per month
Monthly fee of €549.
Minimum term: 3 consecutive calendar months.
After the initial 3-month period, the agreement automatically renews for successive 3-month periods at the same rate, unless terminated in writing with one calendar month's notice before the end of the current period.
Cancellation must be submitted by email at least one calendar month before the end of the current period.
Early termination within a fixed period is not possible. In the event of early termination, the full remaining amount of the current period becomes immediately due.
The payment obligation applies regardless of the Participant's actual use of the services.
5. Right of Withdrawal (Cooling-Off Period)
The Participant has the right to withdraw from the agreement within 14 days of formation, without stating a reason.
If the Participant explicitly requests immediate commencement of services during this period, a proportional amount for services already rendered will be due upon withdrawal.
If the Participant has made full use of the service within the cooling-off period (e.g. received and consumed the Basic package in full), the right of withdrawal lapses.
6. Payment and Collection
Payment is made exclusively via SEPA direct debit.
By agreeing to the terms, the Participant authorises Fitologie to collect payments automatically.
If a direct debit fails, a processing fee of €5 will be charged.
In the event of payment arrears:
Access to the coaching app and services will be suspended;
The full outstanding balance of the current period becomes immediately due;
Statutory interest and extrajudicial collection costs will be charged in accordance with Dutch collection law (Wet Incassokosten).
All collection costs are borne by the Participant.
Fitologie reserves the right to transfer outstanding claims to a debt collection agency.
7. Service Content per Package
7.1 Basic
Written intake questionnaire: the Participant completes a questionnaire so Fitologie can build a tailored 12-week training programme.
One complete 12-week training programme.
One programme adjustment based on the Participant's feedback or difficulties encountered.
One call of up to 10 minutes to discuss the programme or adjustment.
No further contact, guidance, or support beyond the above. The agreement concludes upon delivery.
7.2 Online Coaching
Intake meeting: one intake call or in-person meeting prior to the start of coaching.
Ongoing training blocks of 8–12 weeks, updated monthly based on progress.
One monthly call of up to 20 minutes. The Participant schedules this independently via the provided booking link.
Unused monthly calls expire at the end of the calendar month. Cancellation must be made at least 24 hours in advance. In the event of a no-show or late cancellation, the call is forfeited without replacement.
Unlimited questions via the coaching app. Questions are answered collectively once per week.
Fitologie reserves the right to disregard irrelevant or inappropriate messages.
All communication within this package takes place via the coaching app, not via WhatsApp.
7.3 Premium Coaching
All services included in the Online Coaching package (Article 7.2).
Daily contact via WhatsApp for questions, feedback, and adjustments. Fitologie will respond within 12 hours, including weekends.
Video technique corrections: the Participant submits training footage and Fitologie provides specific feedback on execution and form. Fitologie will respond within 12 hours of submission.
Daily WhatsApp contact and video corrections are in addition to — not a replacement for — the coaching app and monthly call.
8. Personal Training Sessions
Personal training sessions can be booked separately by the Participant, regardless of the chosen package.
Standard rate: €85 per session.
Active coaching clients receive a loyalty discount:
Online Coaching clients: €75 per session.
Premium Coaching clients: €60 per session.
The discount applies only while the Participant holds an active coaching agreement. Upon termination of the agreement, the standard rate applies.
Sessions are invoiced separately via direct debit after the session takes place.
Cancellation must be made at least 24 hours in advance. In the event of a no-show or late cancellation, 100% of the session rate will be charged.
9. No Pause Option
Fitologie does not offer a pause or suspension option for any package.
The payment obligation continues regardless of the Participant's ability to train, including during illness, injury, travel, or other personal circumstances.
No refunds or credits are granted for unused periods due to the Participant's absence or inactivity.
10. Results and Health
Fitologie provides no guarantees regarding physical or mental results.
Results depend on the Participant's effort, consistency, lifestyle, and adherence to advice.
Failure to achieve results does not give rise to any right of refund.
The Participant declares that they are physically and mentally fit to participate. In case of doubt, the Participant should seek medical advice before starting.
Participation is entirely at the Participant's own risk.
11. Liability
Fitologie is not liable for injuries, physical harm, or damage arising from participation.
Fitologie is not liable for indirect damage, consequential loss, or lost income.
Where liability is established, it is limited to the lesser of: the amount paid out by the insurer, or the amount paid by the Participant in the three months preceding the event giving rise to the claim.
Liability for intent or gross negligence is not excluded to the extent prohibited by law.
12. Conduct and Use
The account is personal and non-transferable.
Inappropriate behaviour, insults, harassment, or abuse may result in immediate termination without refund.
Training programmes, video corrections, and all other materials are protected by copyright and may not be distributed or used commercially.
The Participant indemnifies Fitologie against claims by third parties arising from the Participant's acts or omissions.
13. Force Majeure
In the event of force majeure (illness, technical failures, government measures, or other unforeseen circumstances), Fitologie may suspend or adapt its services.
Amounts already paid remain due in principle.
Fitologie will make reasonable efforts to offer a suitable alternative.
14. Amendments to Terms
Fitologie reserves the right to amend these terms and conditions.
Amendments will be communicated by email at least 30 days before they take effect.
In the event of material changes, the Participant has the right to terminate the agreement effective from the date the changes take effect.
15. Privacy
Fitologie processes personal data in accordance with the General Data Protection Regulation (GDPR).
Data is used exclusively for the performance of the agreement.
The Participant has the right to access, correct, and request deletion of their personal data.
